CAN DO PLUMBING
TERMS OF BUSINESS
Version 4.2 - October 2026
Working draft prepared for solicitor review
Important Contract Information
This summary identifies terms which may materially affect the Client. It forms part of these Terms but
does not replace the detailed clauses below.
• Contract acceptance: the Client must reply to the quotation email confirming acceptance of both the
Quotation and these Terms. FreeAgent does not provide a separate approval mechanism used by Can Do
Plumbing.
• Booking: acceptance does not reserve a start date. A date is booked only when Can Do Plumbing
confirms it by email.
• Price validity: quotations are normally open for acceptance for 30 days. If Works commence more than
30 days after the quotation date, demonstrable project-cost changes may require an agreed revised
price.
• Scope and plans: only the stated scope and the plans, drawings, schedules and revisions identified in the
Quotation are priced. Changes, omissions, hidden conditions and additional requirements may require
a variation.
• Variations: chargeable additional work normally requires email approval of the scope and price or
charging basis before it proceeds. Only minimum urgent safety or damage-prevention action may be
taken without prior approval.
• Payment: undisputed sums remain payable by the invoice due date. A complaint does not automatically
suspend the whole invoice, subject always to statutory rights.
• Existing property and residual water: draining, isolation, disturbance, testing and recommissioning may
expose existing weaknesses, and reasonable precautions cannot guarantee that plumbing or heating
systems contain no residual water.
• Client property: vulnerable possessions and appliances should be removed from the working area. Can
Do Plumbing will not use Client-owned tools or cleaning equipment without express permission.
• Complaints and alleged damage: Can Do Plumbing must be given a reasonable opportunity to inspect
before non-urgent third-party remedial work is undertaken. Relevant evidence should be preserved.
• Consumer rights: statutory rights, including applicable cancellation rights and remedies for services not
carried out with reasonable care and skill, are not restricted.
1. Definitions

0BE.
1.2 Client means the individual, landlord, letting agent, business or organisation instructing the Contractor.
1.3 Consumer Client means an individual acting mainly for purposes outside their trade, business or
profession.
1.4 Commercial Client means a person or organisation contracting mainly for business purposes.
1.5 Works means the plumbing, heating, gas, installation, diagnostic or associated services agreed between
the Contractor and Client.

CAN DO PLUMBING
1.6 Quotation means a price offered for a defined scope of Works, subject to stated assumptions, exclusions
and variations. Can Do Plumbing uses FreeAgent to prepare and issue quotations. FreeAgent may display
the document heading “Estimate”; where Can Do Plumbing issues that document as a fixed price for a
defined scope of Works, it is a Quotation for the purposes of these Terms notwithstanding the software-
generated label.
1.7 Estimate means a price which Can Do Plumbing expressly identifies as indicative, budgetary or subject
to adjustment as the scope, cost or circumstances change. A document is not an Estimate for the purposes
of these Terms merely because FreeAgent displays the heading “Estimate”.
1.8 Completion means the Works are substantially complete, safe and operational notwithstanding minor
snagging items which do not prevent reasonable use.
1.9 Business Day means Monday to Friday excluding Scottish public holidays and notified periods of
annual leave.
1.10 Formal Email Notice means an email sent to candoplumbing.edinburgh@gmail.com which clearly
identifies the Client, the property, the relevant Works and the acceptance, instruction, decision,
cancellation, complaint or issue being communicated.
1.11 Terms means this version of Can Do Plumbing's Terms of Business supplied with the relevant
Quotation or Estimate.
1.12 Authorised Decision-Maker means the Client or another person whose authority to approve
instructions, variations, costs or contractual decisions has been confirmed by the Client by Formal Email
Notice.
1.13 Whether a Client is a Consumer Client or Commercial Client depends upon the capacity and main
purpose for which that Client enters the contract. The description 'landlord', ownership of a rental
property or use of a managing agent does not by itself determine status. Nothing in these Terms removes a
statutory protection which applies as a matter of law.
2. Scope of Works
2.1 Works shall be carried out with reasonable care and skill and, where applicable, in accordance with
relevant regulations and manufacturer instructions.
2.2 The Contractor is responsible only for Works expressly included within the agreed quotation, estimate
or written instruction.
2.3 Anything not expressly included shall be deemed excluded, except to the extent that applicable law
requires otherwise.
2.4 Instructions which alter or expand the agreed scope constitute a variation.
2.5 Hidden defects, unforeseen conditions and matters which could not reasonably have been identified
before commencement may constitute additional work.
2.6 The Contractor may refuse or suspend any instruction which would compromise safety, regulations,
manufacturer requirements, structural integrity or professional standards.
3. Quotations, Estimates and Surveys
3.1 Unless expressly agreed otherwise, quotation and survey visits are visual and non-invasive.
3.2 Floorboards, flooring, bath panels, boxing, ceilings, cupboards, wall finishes and concealed areas will
not normally be removed or opened during a quotation visit.
3.3 Quotations are based upon conditions reasonably visible or disclosed at the time.
3.4 The Contractor shall not be responsible for failing to identify a condition which could not reasonably
have been discovered without invasive investigation.
Can Do Plumbing - Terms of Business v4.2 | Page 2
Page 3 of 22
CAN DO PLUMBING
3.5 Unless the Quotation states another period, a Quotation remains open for acceptance for 30 days from
its date. Acceptance within that period does not guarantee that the quoted price will remain unchanged if
the Works are scheduled or postponed to commence more than 30 days after the Quotation date.
3.5A Where the Works are due to commence more than 30 days after the Quotation date, Can Do Plumbing
may review the price before commencement to reflect demonstrable changes in material, supplier,
subcontractor or other project costs. Any proposed revision will be explained and must be accepted by
Formal Email Notice before the affected Works proceed.
3.6 FreeAgent may display the heading 'Estimate'. Where Can Do Plumbing issues that document as a fixed
price for a defined scope, it will operate as a Quotation as explained in clauses 1.6 and 1.7.
3.6A A Quotation is formally accepted only when the Client replies by email confirming acceptance of both
the Quotation and the version of these Terms supplied with it.
3.6B Can Do Plumbing does not use a separate approval mechanism within FreeAgent. Verbal agreement,
SMS, WhatsApp, social-media messages, payment of a deposit or other conduct will not by itself constitute
formal acceptance unless Can Do Plumbing subsequently records and confirms acceptance by email.
3.6C Acceptance of a Quotation does not by itself reserve a particular commencement date. A proposed or
discussed date remains provisional until Can Do Plumbing confirms the booking by email.
3.6D An acceptance reply is sufficient where, read together with the email thread, it clearly confirms
agreement to the identified Quotation and the version of these Terms attached to or supplied with it. Can
Do Plumbing will retain that email with the job record.
3.6E Before acceptance, each Quotation will identify, so far as applicable: the property; the priced scope;
material assumptions and exclusions; the price and VAT treatment; payment or deposit requirements;
relevant plans and revisions; responsibility for Client-supplied items; and whether separate consumer
cancellation information accompanies the Quotation.
3.7 Timescales and commencement dates are estimates unless expressly guaranteed in writing.
3.8 Where Works are priced from plans, drawings, schedules or specifications, the documents and
revisions relied upon will be identified within the Quotation. Only the documents expressly referenced in
the Quotation form part of the priced scope.
3.9 The Client or Project Manager is responsible for ensuring that Can Do Plumbing receives the latest
applicable plans, drawings, schedules and specifications before the Quotation is prepared and before the
Works commence.
3.10 Can Do Plumbing is not responsible for Works, components or requirements omitted from, unclear
within or inconsistent across the referenced documents where the matter could not reasonably have been
identified from the information supplied.
3.11 Revised, additional or corrected plans issued after the Quotation may constitute a variation. Can Do
Plumbing may reassess the scope, programme and price before carrying out the affected Works.
3.12 Review of plans for design adequacy, coordination, omissions, compliance or opportunities for
improvement is excluded unless a separate plan-review, design or consultancy service is expressly
included and paid for.
3.13 Unless such a service is included, Can Do Plumbing is not obliged to recommend improvements or
identify matters missing from third-party plans. Nothing requires Can Do Plumbing to undertake Works
known to be unsafe, unlawful or contrary to applicable manufacturer instructions.
3.14 All plans, dimensions, product positions and service routes remain subject to site verification, actual
dimensions, manufacturer requirements and conditions discovered during the Works.
3.15 Reasonable site adjustments may be required to achieve a safe, functional and compliant installation.
A material adjustment affecting scope, specification, programme or price will be treated as a variation
under Section 4.

CAN DO PLUMBING
4. Variations and Additional Works
4.1 An instruction which alters or expands the agreed scope is a proposed variation and may affect price,
materials, programme and completion dates.
4.2 Except for the limited urgent action described in clause 4.6, Can Do Plumbing will not undertake a
chargeable variation until its scope and either its price or charging basis have been provided and approved
by an Authorised Decision-Maker by Formal Email Notice.
4.3 Approval of a variation confirms the Client's agreement to the described change and its stated price or
charging basis. Can Do Plumbing will retain the approval with the job records.
4.4 Defective, unsafe, inaccessible or non-compliant existing installations are not automatically included
within the original contract price and may require a separate variation.
4.5 Where an exact price cannot reasonably be established in advance, the proposed variation will state
the applicable labour basis and that materials, subcontractor charges, delivery, collection, disposal and
other reasonable associated costs may be charged where relevant.
4.6 Where immediate action is reasonably necessary to prevent material damage, make an installation safe
or comply with a legal or regulatory requirement, Can Do Plumbing may take the minimum necessary
action where waiting for approval would create unreasonable risk.
4.7 Urgent work under clause 4.6 will be limited to the minimum action reasonably required to address the
immediate risk. The Client will be informed as soon as reasonably practicable of the action taken and any
charge calculated using the previously disclosed charging basis or, where none was disclosed, a reasonable
price.
4.8 Agreement by Can Do Plumbing to quote for, undertake or assist with additional, alternative or
remedial Works does not, by itself, constitute an admission that earlier Works were defective, incomplete
or included within the original scope.
5. Payment Terms
5.1 Payment is due in accordance with the due date shown on the relevant invoice.
5.2 Deposits, advance material payments and staged payments may be required.
5.3 Deposits may be used to purchase materials required for the Works.
5.4 Where a quotation specifies staged payments, each stage becomes due when the relevant stage of
Works has been substantially reached.
5.5 Failure to pay a properly due stage payment may result in suspension of further Works until payment
is received.
5.6 A resulting delay caused by non-payment shall not be treated as delay by Can Do Plumbing.
Prices and Charges
5.6A Each Quotation or Estimate will state the price, applicable VAT treatment and, where reasonably
calculable, the total amount payable.
5.6B Charges for additional or time-based Works will be calculated using the price or charging basis
disclosed in the relevant Quotation, Estimate, schedule of charges or approved variation.
5.6C Materials, delivery, collection, parking or access charges outside the ordinary Edinburgh trade-
parking arrangements, disposal, plant hire and subcontractor costs are included only where the relevant
document states that they are included.
5.6D Where a total price cannot reasonably be calculated in advance, Can Do Plumbing will explain how
the price will be calculated and identify any reasonably foreseeable additional charges before the Client
becomes bound, where required by law.

CAN DO PLUMBING
Formal Payment Disputes
5.7 A Client wishing to dispute all or part of an invoice must provide Formal Email Notice.
5.8 The Formal Email Notice must:
• identify the invoice or Works;
• state the exact amount disputed;
• explain the factual basis of the dispute; and
• include reasonably available supporting evidence.
5.9 Telephone calls, voicemail, SMS, WhatsApp, social-media messages or verbal discussions do not by
themselves constitute a formal payment dispute.
5.10 The purpose of requiring written notice is to ensure both parties have an accurate record of the
matter requiring resolution.
5.11 A minor or limited issue should not ordinarily justify withholding the whole invoice, subject always to
the Client's statutory rights.
5.12 Any amount withheld should be reasonably proportionate to the specific matter genuinely in dispute,
subject always to the Client's statutory rights.
5.13 All undisputed sums remain payable by the original due date.
5.13A A complaint, alleged counterclaim or allegation of property damage does not automatically suspend
payment of the whole invoice. The Client should withhold only the amount genuinely and reasonably
disputed, explain how that amount has been calculated and pay all remaining undisputed sums by the
original due date, subject always to the Client's statutory rights.
5.13B The fact that a fault, failure or item of damage is discovered after the Works does not, by timing
alone, establish that it was caused by Can Do Plumbing. Responsibility will be assessed having regard to the
Works undertaken, the condition and location of the item, the available records and any relevant
independent evidence.
Late Payment
5.14 Where an invoice remains unpaid for more than five Business Days after its due date, Can Do
Plumbing may:
• issue reminders;
• suspend further Works;
• decline additional attendance;
• cancel future work slots;
• commence formal debt recovery; and
• claim lawful interest, compensation and recovery costs.
5.15 For qualifying Commercial Client debts, Can Do Plumbing reserves the right to claim statutory late-
payment interest and compensation.
5.16 For Consumer Clients, only reasonable and lawful recovery costs or interest may be claimed.
5.17 No term shall operate as an unlawful or disproportionate penalty.

CAN DO PLUMBING
Goodwill Reductions
5.18 Where Can Do Plumbing offers a discretionary goodwill reduction, the original amount, the reduction,
and the reduced amount payable will be stated clearly.
5.19 The reduction may be conditional on payment being received within the period expressly stated in
writing, which may include a 24-hour payment period where clearly identified in the offer.
5.20 If payment is not received within that period, Can Do Plumbing may withdraw the goodwill reduction.
The original amount previously stated to the Client will then remain due, less any sums already paid.
5.21 A goodwill reduction does not constitute an admission of fault or liability.
6. Deposits, Materials and Cancellation Costs
6.1 Materials remain the property of Can Do Plumbing until paid for in full where legally and practically
possible.
6.2 Special-order, bespoke, altered or non-returnable products may remain chargeable where cancellation
occurs after ordering.
6.3 Supplier restocking charges caused by Client-requested cancellation or changes may be passed on
where reasonable.
6.4 Where a Client cancels Works, Can Do Plumbing may recover reasonable losses directly arising from
cancellation, including:
• materials already ordered;
• non-refundable supplier charges;
• work already completed;
• subcontractor charges already committed; and
• other genuine losses lawfully recoverable.
6.5 Can Do Plumbing shall not retain or charge an arbitrary cancellation sum which exceeds reasonable
recoverable loss.
6.6 Client-requested changes to products, quantities, finishes or specification after materials have been
ordered may result in additional supplier charges, restocking charges, delivery or collection costs,
additional labour and programme changes. Such costs may be charged where reasonably incurred and
where permitted by law.
6.7 A deposit is a payment on account and not automatically non-refundable. On lawful cancellation or
termination, Can Do Plumbing will account for the deposit against completed work and reasonably
incurred or committed recoverable costs and will refund any balance due.
6.8 Can Do Plumbing may delay ordering materials or committing subcontractors until any required
deposit or advance payment has cleared. A resulting procurement or programme delay is not Contractor
delay.
7. Consumer Cancellation Rights
7.1 Consumer Clients may have statutory cancellation rights where contracts are entered into remotely,
online, by telephone, at the Client's property or otherwise away from Can Do Plumbing's business
premises.
7.2 Where applicable, the Client shall be provided separately with the required cancellation information.
7.3 Where the Client requests Works to commence during an applicable statutory cancellation period, Can
Do Plumbing may require an express written request before starting.
7.4 If a Consumer Client validly cancels after requesting early commencement, the Client may remain
responsible for amounts lawfully due for services already supplied or other legally recoverable costs.
Can Do Plumbing - Terms of Business v4.2 | Page 6
Page 7 of 22
CAN DO PLUMBING
7.5 Nothing in these Terms restricts statutory cancellation rights.
7.6 The ordinary contractual method for cancelling or postponing accepted Works is Formal Email Notice.
A cancellation or postponement takes effect when received, subject to statutory rights and any costs
lawfully recoverable under these Terms.
7.7 Nothing in clause 7.6 invalidates a statutory cancellation which the law permits the Consumer Client to
communicate by another clear statement.
7.8 Where statutory cancellation rights apply, the Quotation email and cancellation documents should be
read together. Can Do Plumbing will retain evidence of the information supplied and any express request
for early commencement.
7.9 Unless emergency circumstances lawfully justify otherwise, Can Do Plumbing will not commence
chargeable non-urgent Works during an applicable cancellation period without the Consumer Client's
express early-start request where such a request is legally required.
8. Existing Installations and Recommissioning
8.1 Can Do Plumbing is not responsible for defects existing before commencement of the Works.
8.2 Alteration, draining, isolation, repressurisation, testing or recommissioning may expose previously
unidentified weaknesses or failures.
8.3 Failure of an existing valve, fitting, pipe, radiator, seal, appliance or component following reasonable
disturbance does not automatically constitute defective workmanship.
8.4 Necessary remedial Works arising from pre-existing defects may be charged separately.
9. Residual Water
9.1 Plumbing and heating systems cannot always be made completely free from residual water before
pipework is cut, disconnected or altered.
9.2 Water may remain trapped within pipework, fittings, radiators and concealed sections despite
reasonable draining procedures.
9.3 The Contractor shall take reasonable precautions to minimise and contain residual water.
9.4 Can Do Plumbing shall not be responsible for loss caused solely by unavoidable residual water where
reasonable care has been exercised.
9.5 Nothing excludes liability arising from negligence.
9.6 Residual water from heating or plumbing systems may contain corrosion products, treatment
chemicals, magnetite, debris or other discolouration and may mark absorbent finishes if unexpectedly
released.
9.7 Where Can Do Plumbing becomes aware of a material escape of water or identified damage requiring
the Client's attention, it will be recorded and communicated to the Client as soon as reasonably practicable.
10. Access and Client Responsibilities
10.1 The Client must provide safe and reasonable access at agreed times.
10.2 The Client should remove or protect valuables, fragile belongings and possessions from immediate
working areas.
10.2A Before the Works commence, the Client should remove or securely protect movable possessions,
electrical appliances, cleaning equipment and other vulnerable items from the immediate working area
and from cupboards, units or access routes reasonably required for the Works.
10.2B Can Do Plumbing will not use Client-owned tools, appliances or cleaning equipment unless the Client
has expressly authorised that use. Nothing in this clause restricts liability for loss or damage caused by a
failure to exercise reasonable care and skill.
Can Do Plumbing - Terms of Business v4.2 | Page 7
Page 8 of 22
CAN DO PLUMBING
10.2C Where the Client does not remove or protect an item after a reasonable request, Can Do Plumbing
will not be responsible for loss caused solely by that failure, provided reasonable care and skill have
otherwise been exercised.
10.3 The Client must disclose known hazards, asbestos, concealed services, structural defects, previous
leaks or relevant alterations.
10.4 Failed access may result in a reasonable attendance charge.
10.5 Diagnostic and investigative attendances are chargeable whether or not a subsequent repair is carried
out.
10.6 Appointments cancelled with less than 24 hours' notice may be charged where Can Do Plumbing
suffers a reasonable loss.
Property Access, Welfare Facilities, Utilities and Occupants
10.7 Where Can Do Plumbing is given access to a property and is left unattended by the Client or occupier,
all reasonable care will be taken to protect the property and its contents while the Works are being carried
out.
10.8 Unless otherwise agreed, Can Do Plumbing will only enter rooms or areas reasonably required to
access, undertake, inspect, test or complete the Works.
10.9 Where Can Do Plumbing is required to remain at the property for the purpose of carrying out the
Works, reasonable access must be maintained to a usable toilet facility and drinkable water, unless
otherwise agreed in advance.
10.10 Can Do Plumbing uses battery-powered tools and equipment in the normal course of its work. Where
reasonably necessary to carry out or complete the Works, batteries, chargers and associated equipment
may be connected to a suitable electrical supply within the property.
10.11 Unless otherwise agreed in writing, Can Do Plumbing is not responsible for any increase in the
Client's electricity consumption or electricity costs arising from the reasonable use of the property's
electrical supply for charging batteries, operating tools, testing equipment or otherwise carrying out the
Works.
10.12 Where gas Works are being carried out, gas may need to be consumed for commissioning, testing,
purging, safety checks, combustion analysis, appliance operation or other procedures reasonably
necessary to carry out, complete or verify the Works.
10.13 Unless otherwise agreed in writing, Can Do Plumbing is not responsible for the cost of gas reasonably
consumed during commissioning, testing or other procedures required in connection with the Works.
10.14 Can Do Plumbing does not agree to be left alone in a property where the only other person present is
under 18 years of age.
10.15 The Client or occupier is responsible for ensuring that an adult aged 18 or over remains present
where a person under 18 would otherwise be left alone at the property with Can Do Plumbing.
10.16 Can Do Plumbing does not accept responsibility for the supervision, care or safeguarding of any
person under 18 at the property.
10.17 If Can Do Plumbing becomes aware that it has been left alone at the property with a person under 18,
Can Do Plumbing may suspend the Works and leave the property until an adult aged 18 or over is present.
10.18 Any reasonable delay, aborted attendance or additional cost arising from such circumstances may be
chargeable where the circumstances were outside Can Do Plumbing's reasonable control.
10.19 The Client or occupier must keep pets and animals under appropriate control and away from the
immediate working area where reasonably necessary for safety, hygiene or uninterrupted access.
Can Do Plumbing - Terms of Business v4.2 | Page 8
Page 9 of 22
CAN DO PLUMBING
10.20 Can Do Plumbing may pause or leave the Works where an animal creates a reasonable safety, access
or welfare concern. Any resulting reasonable delay or additional attendance cost may be chargeable where
outside Can Do Plumbing's reasonable control.
10.21 Where keys, access codes, alarm details or other security information are provided, Can Do Plumbing
will take reasonable care of that information or property and use it only as reasonably required for the
agreed Works.
10.22 The Client is responsible for ensuring that Can Do Plumbing and any agreed subcontractors have
lawful and sufficient authority to access the property at the agreed times.
10.23 Where the Client, occupier, landlord or authorised representative provides Can Do Plumbing with
keys, fobs or other physical means of access for the purpose of carrying out the Works, Can Do Plumbing
will take reasonable care of them while they are in its possession.
10.24 Keys or access devices will only be used for access reasonably required in connection with the agreed
Works and will not knowingly be provided to any unauthorised person.
10.25 Where Works extend over more than one attendance or multiple days, Can Do Plumbing may retain
the keys or access devices for the duration reasonably required to complete the Works, unless alternative
arrangements are agreed.
10.26 Can Do Plumbing may permit a worker or subcontractor engaged in the agreed Works to use the keys
or access devices where reasonably necessary for the performance of those Works.
10.27 The Client is responsible for ensuring that Can Do Plumbing has authority to access the property and
that any landlord, occupier, managing agent, concierge or other relevant person has provided any
necessary permission.
10.28 If keys or access devices are lost or damaged while in Can Do Plumbing's custody through a failure to
exercise reasonable care, Can Do Plumbing will be responsible only to the extent required by applicable
law.
10.29 Can Do Plumbing is not responsible for loss arising from pre-existing security defects, duplicate keys
held by other persons, changes to locks or access arrangements made without notification, or access by
persons outside Can Do Plumbing's reasonable control.
10.30 On completion of the relevant Works, or when reasonably requested, keys or access devices will be
returned by an agreed reasonable method. Where Can Do Plumbing is the last person leaving a property
unattended, reasonable steps will be taken to secure doors and windows opened or accessed by Can Do
Plumbing. Can Do Plumbing is not responsible for the security of doors, windows, locks or alarm systems
which were defective, insecure or improperly functioning before or independently of the Works.
10.31 The Client must, where reasonably required for the Works, provide functioning water, drainage,
electricity and gas supplies necessary to carry out, test and commission the installation unless otherwise
agreed.
10.32 Where a required utility or service is unavailable, unsafe or unsuitable and this prevents proper
completion, testing or commissioning, the affected Works may be delayed and a reasonable additional
attendance or associated cost may be chargeable where the matter is outside Can Do Plumbing's
reasonable control.
10.33 If suspected asbestos, hazardous material, unsafe contamination or another material health or safety
risk is discovered, Can Do Plumbing may immediately stop or restrict the affected Works until the risk has
been appropriately assessed or made safe.
10.34 Specialist testing, removal, remediation or clearance of asbestos or other hazardous materials is
excluded unless expressly included within the quotation or subsequently agreed in writing.

Page 10 of 22
CAN DO PLUMBING
10.35 Any reasonable delay, specialist cost, repeated attendance or programme change resulting from such
a discovery may be treated as additional where the condition was not reasonably identifiable before
commencement and the cost is lawfully recoverable.
11. Existing Finishes and Making Good
11.1 Plumbing and heating Works may require access through walls, ceilings, floors, boxing, cabinetry or
finishes.
11.2 Exact matching of tiles, sanitaryware, grout, silicone, flooring, paint, panels or cabinetry cannot be
guaranteed.
11.3 Specialist plastering, decoration, joinery, tiling and flooring are excluded unless specifically included.
11.4 Access panels or openings required for maintenance may remain visible.
11.5 Where waste removal is included, it is limited to reasonable waste arising directly from the agreed
Works unless otherwise stated. Pre-existing waste, excessive quantities, hazardous materials or specialist
disposal requirements are excluded unless expressly included.
12. Flooring, Floorboards and Structural Access
12.1 Where floors or floorboards must be lifted or cut, reinstatement shall be safe and reasonably
serviceable unless specialist reinstatement is included.
12.2 Can Do Plumbing does not act as a flooring, structural or joinery specialist unless expressly agreed.
12.3 Structural timbers shall not be excessively cut, drilled or notched where safety may be compromised.
12.4 Concealed services, unknown joist arrangements and previous alterations may prevent reinstatement
to the original appearance.
12.5 Where structural suitability cannot reasonably be established within Can Do Plumbing's professional
competence, Can Do Plumbing may pause the affected Works and require advice or approval from an
appropriately competent structural, joinery or other specialist before proceeding.
12.6 Any resulting specialist fees, additional Works or programme implications are excluded from the
original price unless expressly included or subsequently agreed in writing.
13. Client-Supplied and Reused Items
13.1 Can Do Plumbing does not provide a manufacturer's or product warranty on Client-supplied
materials.
13.2 Additional time caused by missing, incorrect, damaged, incompatible or incomplete Client-supplied
items may be chargeable.
13.3 Can Do Plumbing may refuse installation of unsafe or unsuitable items.
13.4 Existing items reused at the Client's request remain subject to their existing age and condition.
13.5 The Client is responsible for ensuring that Client-supplied items are complete, available at the
property, compatible with the installation and accompanied by all required components and instructions.
13.6 Additional attendance, adaptation, delay or abortive time caused by a Client-supplied item may be
charged where the cost and charging basis have been explained and approved in accordance with Section
4.
13.7 Can Do Plumbing remains responsible for exercising reasonable care and skill in installing an
accepted Client-supplied item, but is not responsible for the product's inherent defect, performance
limitation, suitability selected by the Client or manufacturer warranty.
13.8 Removed appliances, sanitaryware, fittings and other Client-owned items remain the Client's property
unless disposal is expressly included. Where an item is left in Can Do Plumbing's custody, the Client must
arrange collection within the reasonable period stated in an email notice.
Can Do Plumbing - Terms of Business v4.2 | Page 10
Page 11 of 22
CAN DO PLUMBING
13.9 If an item is not collected after reasonable written notice, Can Do Plumbing may charge reasonable
storage or disposal costs and may dispose of the item where lawful. An item relevant to a known
complaint, insurance matter or dispute will not be disposed of while its preservation is reasonably
required.
14. Gas Safety
14.1 Gas Works shall only be undertaken where safe and lawful.
14.2 Unsafe installations shall not knowingly be left operating.
14.3 Can Do Plumbing may isolate, disconnect or classify unsafe installations where required.
14.4 Additional remedial Works required to make existing installations safe are not automatically included
within the original price.
15. Snagging and Workmanship Defects
15.1 Alleged snagging or workmanship concerns should be notified as soon as reasonably practicable.
15.2 To commence the formal defect-resolution procedure, the Client must provide Formal Email Notice.
15.3 The notice should state:
• the property;
• relevant Works;
• description of the alleged defect;
• when it was observed;
• whether the installation remains in use;
• photographs or video where reasonably available; and
• whether any third party has inspected or altered the Works.
15.4 Telephone, SMS, WhatsApp and verbal discussions may alert Can Do Plumbing to a concern, but do
not ordinarily constitute Formal Email Notice.
15.5 Can Do Plumbing must be given reasonable opportunity to inspect and, where appropriate, rectify an
alleged defect before another contractor is instructed, except where immediate action is required for
safety or to prevent substantial continuing damage.
15.6 Failure to provide a reasonable inspection opportunity may affect responsibility for third-party
remedial costs.
15.7 A third-party report or opinion will be considered on its individual merits but does not, by itself,
establish responsibility or liability.
15.8 Where a Client relies upon a third-party report or opinion, the Client should provide a copy of the
relevant report or findings and, where appropriate, details of the author's qualifications, the date of
inspection and the Works or conditions actually inspected.
16. Leaks and Duty to Minimise Damage
16.1 An active leak, escape of water or condition capable of causing continuing damage should be reported
immediately.
16.2 Emergency attendance should be requested by telephone. Written messages should not be relied upon
as an emergency attendance request unless Can Do Plumbing expressly acknowledges the message as such.
16.3 Where telephone contact is not answered, the Client should leave a voicemail and take any other
reasonable steps necessary to protect persons and property, including contacting an appropriate
emergency service or alternative competent contractor where required.

CAN DO PLUMBING
16.4 Where safe, the Client or occupier should take reasonable steps to reduce further damage, including
isolating the affected supply or stopping use of the fitting.
16.5 No person should place themselves at risk.
16.6 Any allegation that the leak arose from defective workmanship must subsequently be confirmed by
Formal Email Notice under Section 15.
16.7 Notification of a leak does not constitute an admission of liability.
16.8 Can Do Plumbing should be given reasonable opportunity to inspect before third-party remedial
Works occur, except where urgent intervention is necessary.
16.9 Where emergency third-party intervention is required, the Client should where reasonably possible
preserve photographs, videos, removed parts and written findings.
16.10 Urgent third-party intervention should be limited to action reasonably required to make the situation
safe or prevent material continuing damage. Non-urgent investigation, cleaning, repair or replacement
costs should not be incurred on behalf of Can Do Plumbing without first providing a reasonable
opportunity to inspect and respond.
16.11 The Client should take reasonable steps to preserve any allegedly damaged item and relevant
evidence. Except where urgent action is reasonably necessary for safety or to prevent further material
damage, Can Do Plumbing or its insurer should be given a reasonable opportunity to inspect the item
before it is repaired, altered or disposed of.
16.12 If relevant evidence is disposed of, materially altered or otherwise made unavailable before a
reasonable opportunity to inspect has been provided, this may affect Can Do Plumbing's ability to assess
responsibility and the recoverability of the claimed cost. This clause does not restrict the Client's statutory
rights.
17. Bathrooms and Specialist Installations
17.1 Bathroom refurbishment may reveal concealed defects after sanitaryware, finishes or furniture are
removed.
17.2 Existing walls, floors and structures may require additional preparation.
17.3 Shower screens, wall panels and specialist products will be installed subject to manufacturer
tolerances and existing site conditions.
17.4 Minor unavoidable variation caused by walls, floors or structures being out of square, level or plumb
shall not constitute defective workmanship where the installation remains safe and functional.
17.5 Independent tiling, flooring, decoration, joinery or third-party Works are outside Can Do Plumbing's
workmanship warranty unless expressly contracted through Can Do Plumbing.
17.6 Following installation, the Client must observe any drying, curing or no-use period advised by Can Do
Plumbing or the relevant manufacturer. This may include silicone, grout, adhesives, wall-panel sealants,
waterproofing products and other finishes.
17.7 Baths, showers, tiled areas and other affected installations must not be used, disturbed or exposed to
water during an advised curing or no-use period.
17.8 Can Do Plumbing shall not be responsible for deterioration, leakage, movement, staining or failure
caused by use, interference or exposure to water before the advised curing or no-use period has expired.
17.9 Bathroom refurbishment may temporarily leave the property without use of the affected toilet, bath
or shower. Unless alternative facilities or temporary arrangements are expressly included within the
quotation, the Client is responsible for ensuring suitable alternative facilities are available where required.
18. Subcontractors
18.1 Can Do Plumbing may appoint suitably competent subcontractors or specialist trades.
Can Do Plumbing - Terms of Business v4.2 | Page 12
Page 13 of 22
CAN DO PLUMBING
18.2 Can Do Plumbing remains responsible for services expressly contracted through it, subject to these
Terms and applicable law.
18.3 Where reasonably necessary, subcontractors or specialist trades may require direct access to the
property to carry out the part of the Works allocated to them, subject to the agreed programme and access
arrangements.
18.4 Reasonable delay caused by the availability, illness, cancellation or rescheduling of a subcontractor or
specialist trade will be dealt with under Section 19 where the circumstances are outside Can Do Plumbing's
reasonable control.
19. Programme and Delays
19.1 Programme dates and completion dates are estimates unless expressly guaranteed.
19.2 Can Do Plumbing shall not be responsible for reasonable delays caused by circumstances outside its
control, including:
• material delays;
• supplier delays;
• illness;
• hidden conditions;
• access difficulties;
• Client delay;
• delays by other trades; or
• unsafe working conditions.
19.3 Client-caused delay resulting in repeated attendance, rescheduling, subcontractor charges, storage,
delivery or collection costs may result in reasonable additional charges.
19.4 A requested change to an agreed commencement date must be made by Formal Email Notice.
Rescheduling is subject to availability and may affect the programme, subcontractor arrangements,
material costs and price.
19.5 Where the Client postpones or prevents progress for more than 20 Business Days, Can Do Plumbing
may require a revised programme, payment for completed Works and committed costs, reimbursement of
reasonable storage or repeated-delivery costs, and review of the remaining price before recommencement.
19.6 Can Do Plumbing may suspend affected Works where payment properly due remains unpaid, access is
unavailable, a required decision or approval has not been provided, conditions are unsafe, the Client
materially breaches the contract or continuing would require unlawful or professionally improper work.
19.7 Except where immediate suspension is reasonably necessary for safety, legality or serious misconduct,
Can Do Plumbing will explain the reason for suspension by email and provide a reasonable opportunity to
remedy the issue where it is capable of remedy.
19.8 Either party may terminate the uncompleted part of the contract by Formal Email Notice where the
other commits a material breach and, where the breach is capable of remedy, fails to remedy it within a
reasonable period stated in the notice.
19.9 Can Do Plumbing may terminate immediately by email where continuing would create a serious
safety risk, require unlawful work, expose a person to threatening or abusive conduct, or where the Client
clearly indicates that Can Do Plumbing will not be permitted to complete the agreed Works.
19.10 On suspension or termination, the Client remains responsible for properly due amounts for
completed Works, supplied or committed materials, non-refundable supplier or subcontractor
commitments and reasonable demobilisation, storage or collection costs, so far as lawfully recoverable.
Can Do Plumbing will account for any deposit against those sums and refund any balance lawfully due.
Can Do Plumbing - Terms of Business v4.2 | Page 13
Page 14 of 22
CAN DO PLUMBING
19.11 Termination does not affect rights or liabilities which arose before termination, including statutory
rights and genuine claims for breach.
20. Completion, Handover and Snagging
20.1 Works shall be regarded as substantially complete when the agreed installation is safe, operational
and capable of reasonable intended use.
20.2 Minor snagging which does not materially prevent reasonable use shall not prevent substantial
completion.
20.3 Examples may include minor sealing, adjustment, cosmetic finishing or another limited item awaiting
final attendance.
20.4 Work belonging to an independent third party shall not prevent Can Do Plumbing's own Works from
being regarded as complete.
20.5 A manufacturer part awaiting replacement under warranty shall not automatically render the entire
contract incomplete where the remaining Works are otherwise usable and safe.
20.6 The Client should identify reasonably observable snagging promptly following completion.
20.7 Can Do Plumbing shall be provided reasonable access to rectify legitimate snagging.
20.8 Minor snagging does not entitle the Client to withhold payment disproportionately to the value of that
snagging.
20.9 Any certificate, safety record or commissioning document which Can Do Plumbing is legally or
technically required to issue will be provided in accordance with the applicable requirement and will not
be withheld solely because an invoice is disputed or unpaid.
20.9A Optional handover packs, duplicate documents, manufacturer administration and non-mandatory
supporting information may be provided following completion and payment where lawful.
20.10 Can Do Plumbing may ask the Client, occupier or authorised representative to sign or electronically
acknowledge an attendance record, commissioning record, variation, completion record or handover note.
20.11 Any such acknowledgement records the attendance, information provided and/or Works identified
within that document. It does not remove or restrict any statutory rights which cannot lawfully be
excluded.
20.12 Where the Client is absent at completion, Can Do Plumbing may provide a written or electronic
completion update recording the Works undertaken, limitations, matters requiring monitoring and any
incident reasonably requiring the Client's attention.
20.13 The absence of an incident entry does not, by itself, establish that an item later reported as damaged
was used, handled or damaged by Can Do Plumbing. Any allegation will be considered using all reasonably
available evidence.
21. Photographs and Job Records
21.1 Can Do Plumbing may take photographs of installations, defects, meter readings, appliance details and
relevant site conditions for quotation, safety, job-record, warranty and dispute-resolution purposes.
21.1A Job-record photographs may include the condition of the immediate working area, access routes,
protective coverings, nearby fixtures or possessions, equipment used and the condition of the area at
completion, so far as reasonably necessary and proportionate for contract administration, safety,
insurance or dispute resolution.
21.2 Such photographs will not be used for unrelated marketing without appropriate permission where
required.
Can Do Plumbing - Terms of Business v4.2 | Page 14
Page 15 of 22
CAN DO PLUMBING
21.3 Can Do Plumbing may maintain written job notes, measurements, commissioning records, attendance
records and contemporaneous records of instructions or site conditions for contract administration, safety,
warranty and dispute-resolution purposes.
21.4 Clients should promptly notify Can Do Plumbing if they believe a material factual error appears in a
written attendance, variation or handover record provided to them.
22. Audio Recording of Job-Related Discussions
22.1 Can Do Plumbing may make audio recordings of specific job-related conversations where reasonably
necessary to maintain an accurate record of:
• instructions;
• specifications;
• variations;
• technical discussions;
• site decisions;
• complaints; and
• disputed matters.
22.2 Audio recording is used for accurate contract administration, reducing misunderstandings and
establishing an accurate record where disputes arise.
22.3 Continuous audio surveillance will not ordinarily be undertaken.
22.4 Individuals will be informed before a relevant conversation is recorded unless a lawful exception
applies.
22.5 If an individual objects to recording, Can Do Plumbing will consider the objection and whether
recording remains necessary and proportionate.
22.6 Where reasonably practical, a written record may be used instead.
22.7 Recordings shall only be accessed where reasonably necessary for contract administration, complaint
investigation, insurance, legal advice, regulatory matters or legal proceedings.
22.8 Recordings will normally be retained for no more than 12 months following completion.
22.9 They may be retained longer where reasonably necessary for an unresolved complaint, unpaid debt,
insurance matter, regulatory enquiry or actual or anticipated legal proceedings.
22.10 Recordings shall be stored using reasonable security measures and deleted when no longer required.
22.11 Personal information contained within recordings shall be handled in accordance with Can Do
Plumbing's Privacy Notice.
22.12 The applicable purpose, lawful basis, retention approach and individual data-protection rights
relating to recordings will be explained in Can Do Plumbing's Privacy Notice.
23. Business Hours and Communications
Business Hours
23.1 Normal administrative business hours are: Monday to Friday, 8:00am–5:00pm, excluding Scottish
public holidays and notified annual leave.
23.2 Emails and other written messages received outside those hours will ordinarily be treated as received
on the next Business Day.
Contractor Response Times
23.3 Can Do Plumbing will use reasonable efforts to respond to routine communications within two
Business Days.
Can Do Plumbing - Terms of Business v4.2 | Page 15
Page 16 of 22
CAN DO PLUMBING
23.4 Quotations, technical matters, supplier enquiries and variations may reasonably require longer.
23.5 An immediate response is not guaranteed.
Formal Contract Communications
23.5A Only Formal Email Notice will be formally recognised for acceptance of a Quotation or Estimate,
confirmation or alteration of commencement dates, cancellation or postponement of Works, approval of
variations or additional costs, formal complaints, payment disputes, appointment of an Authorised
Decision-Maker and termination of the contract.
23.5B Telephone calls, voicemail, SMS, WhatsApp, social-media messages and verbal discussions may be
used for informal communication but will not alter the contract or constitute formal acceptance,
cancellation, variation or approval unless the matter is subsequently confirmed by email by the Client or
Can Do Plumbing.
23.5C Clauses 23.5A and 23.5B do not prevent telephone notification of an emergency, active leak or
immediate safety concern and do not restrict a statutory right which may lawfully be exercised through
another clear form of communication.
23.5D Can Do Plumbing may confirm an informal discussion or instruction by email. The Client should
notify Can Do Plumbing promptly by email if that record contains a material factual error.
Emergency Contact
23.6 Emergency attendance must be requested by telephone.
23.7 If unanswered, the Client should leave a voicemail stating:
• name;
• property address;
• telephone number;
• nature of emergency; and
• whether there is an active leak, loss of essential service or immediate safety concern.
23.8 A missed call without voicemail does not necessarily constitute an emergency request.
23.9 Emergency and out-of-hours attendance remains subject to availability and is not guaranteed.
23.10 Emergency attendance may be charged at applicable emergency rates.
Client Response Times
23.11 Clients are expected to respond reasonably promptly to requests for decisions, approvals, access or
information.
23.12 Where a Client decision is required to progress Works, the Client should normally respond within
two Business Days unless another deadline is stated.
23.13 This includes decisions concerning:
• variations;
• specifications;
• products;
• access;
• additional Works;
• sanitaryware;
• tiles;
• flooring;
• subcontractor access; or
Can Do Plumbing - Terms of Business v4.2 | Page 16
Page 17 of 22
CAN DO PLUMBING
• other matters required to progress the job.
23.14 Failure to respond may result in the affected Works being paused.
23.15 Resulting delay shall not be treated as Contractor delay.
23.16 Reasonable additional costs arising directly from Client delay may be charged.
Authorised Decision-Makers
23.17 Where multiple people are involved, the Client should identify an authorised decision-maker.
23.18 Can Do Plumbing may reasonably rely upon instructions from that person.
23.19 Conflicting instructions may result in Works being paused until clarified.
23.20 Where a Client appoints a relative, representative, managing agent or other person to communicate
with Can Do Plumbing, that appointment does not change the identity of the contracting Client unless
expressly agreed in writing.
23.21 Can Do Plumbing may request confirmation of a representative's authority and the extent of that
authority before accepting instructions, variations, settlements or decisions affecting the contract.
23.22 Can Do Plumbing may reasonably pause affected Works or communications where authority is
unclear, disputed or conflicting until satisfactory clarification is provided.
23.22A The Client remains responsible for an instruction given within the authority which the Client has
confirmed for an Authorised Decision-Maker. Can Do Plumbing is not required to resolve internal
disagreements between owners, landlords, agents, occupiers, project managers or other representatives.
Mutual Communication Standard
23.23 Can Do Plumbing recognises the Client's entitlement to reasonable communication and updates.
23.24 In return, Clients are expected to respond reasonably promptly where their decision, approval or
access is required.
23.25 Neither party should unreasonably delay communication in a way that causes avoidable disruption,
cost or uncertainty.
24. Formal Complaints Procedure
24.1 A formal complaint must be made by Formal Email Notice to candoplumbing.edinburgh@gmail.com.
24.2 Telephone calls, SMS, WhatsApp and verbal discussions may provide initial notification of
dissatisfaction but do not by themselves commence the formal complaints procedure unless Can Do
Plumbing confirms by email that the matter has been recorded as a formal complaint.
24.3 The complaint should identify:
• relevant property and Works;
• nature of complaint;
• outcome sought;
• relevant dates; and
• available supporting evidence.
24.3A Any request for complaint evidence will be reasonable and proportionate to the nature and value of
the matter. Where loss of or damage to property is alleged, the Client should provide, so far as reasonably
available: identification of the item or area affected; the date and circumstances of discovery; the factual
basis on which Can Do Plumbing is alleged to be responsible; photographs or video; the make, model,
approximate age and pre-existing condition of any appliance or item; proof of ownership or purchase
where available; any inspection, diagnostic or repair report; and the amount claimed with an explanation
of how it has been calculated.
24.4 Can Do Plumbing will aim to acknowledge a formal complaint within two Business Days.
Can Do Plumbing - Terms of Business v4.2 | Page 17
Page 18 of 22
CAN DO PLUMBING
24.5 Can Do Plumbing will aim to investigate and provide a substantive response within ten Business Days.
24.6 Where the matter is unusually complex or requires third-party investigation, more time may
reasonably be required.
24.7 Where further time is required, Can Do Plumbing will aim to provide an update explaining the reason
for delay.
24.8 Genuine emergency or safety issues should not await the complaints process and should be dealt with
in accordance with Section 16.
24.9 The complaints procedure does not affect statutory rights.
24.10 Can Do Plumbing may issue a preliminary response while evidence is being obtained and will
identify any further information reasonably required from the Client.
24.11 A final response will state whether the complaint is upheld, partially upheld or not upheld, give the
principal reasons and identify any remedy offered.
24.12 If the Client remains dissatisfied after the final response, the parties may consider voluntary
alternative dispute resolution. Any provider, procedure, binding effect and allocation of fees must be
agreed in writing before referral. Participation does not constitute an admission of liability.
24.13 Where applicable law requires Can Do Plumbing to provide information about an accredited
consumer ADR provider after a complaint cannot be resolved internally, that information and Can Do
Plumbing's position on participation will be included in or supplied with the final response.
25. Conduct and Safety
25.1 Can Do Plumbing is entitled to a safe and reasonable working environment.
25.2 Abusive, threatening, aggressive or persistently unreasonable behaviour towards Can Do Plumbing, its
workers or subcontractors will not be accepted.
25.3 Can Do Plumbing may leave the property, suspend Works or terminate attendance where continuing
would reasonably compromise personal safety or expose workers to abusive or threatening conduct.
25.4 Charges properly due for completed Works remain payable.
25.5 Can Do Plumbing may leave or suspend attendance where the circumstances relating to persons
present at the property create a reasonable safeguarding, personal-safety or other welfare concern.
26. Warranty
26.1 Unless stated otherwise, Can Do Plumbing provides a 12-month contractual workmanship warranty
beginning on Completion of the relevant Works.
26.2 The workmanship warranty excludes:
• manufacturer defects;
• Client-supplied products;
• reused components;
• age-related deterioration;
• misuse;
• accidental damage;
• third-party alterations;
• unrelated failures; and
• pre-existing faults elsewhere in the installation.
26.3 Can Do Plumbing must be provided reasonable opportunity to inspect any warranty claim.
26.4 Manufacturer warranties remain subject to manufacturer conditions.
Can Do Plumbing - Terms of Business v4.2 | Page 18
Page 19 of 22
CAN DO PLUMBING
26.5 Statutory rights are unaffected.
26.6 Where Can Do Plumbing rectifies a defect covered by the workmanship warranty, the original
warranty period will continue. A replacement component remains subject to any applicable manufacturer
warranty. No fresh 12-month period arises unless expressly confirmed in writing.
26.7 The Client must follow reasonable operating, servicing, maintenance and manufacturer requirements
relevant to the installation.
26.8 Where an inspection establishes that the reported concern is not caused by covered workmanship, a
reasonable diagnostic or attendance charge may apply only where that possibility and the charging basis
were explained before attendance.
26.9 The 12-month contractual warranty provides an additional procedure and does not impose a 12-
month limit on any statutory claim or remedy available to a Consumer Client.
27. Liability
27.1 Can Do Plumbing maintains public liability insurance.
27.2 Nothing excludes liability where exclusion would be unlawful.
27.3 Nothing excludes the duty to exercise reasonable care and skill.
27.4 Can Do Plumbing shall not be responsible for loss which was not reasonably foreseeable or which did
not arise from breach by Can Do Plumbing.
27.5 Can Do Plumbing is not responsible for loss arising solely from matters outside its agreed scope or
reasonable control.
27.6 Where Can Do Plumbing accepts responsibility for damage to property, the appropriate remedy will
be assessed reasonably according to the circumstances and may include repair, professional cleaning,
reinstatement or payment representing the item's reasonable value immediately before the damage.
27.7 Compensation will not automatically be calculated using the cost of a brand-new replacement where
that would place the Client in a materially better position than immediately before the loss, subject always
to applicable law and the Client's statutory rights.
27.8 Can Do Plumbing may refer any allegation of personal injury, property damage, consequential loss or
other potentially insured event to its insurer. Referral, investigation or an offer expressly made without
admission does not constitute acceptance of liability.
28. Debt Recovery
28.1 Unpaid accounts may be referred for debt recovery or legal proceedings.
28.2 Can Do Plumbing reserves the right to recover interest, lawful statutory compensation, court fees and
reasonable recovery costs where permitted.
28.3 Acceptance of part-payment does not waive entitlement to the remaining balance unless expressly
agreed.
29. Data Protection
29.1 Can Do Plumbing may process personal information for quotation, contract administration,
performance of Works, invoicing, regulatory compliance, warranty, safety and dispute resolution.
29.2 Further information is contained in the Can Do Plumbing Privacy Notice.
30. Contract Formation, Document Priority and Severability
30.1 Can Do Plumbing will ordinarily send the Quotation or Estimate and these Terms by email. The Client
should retain both documents.
Can Do Plumbing - Terms of Business v4.2 | Page 19
Page 20 of 22
CAN DO PLUMBING
30.2 A contract based upon a Quotation is formed when Can Do Plumbing receives the Client's email reply
expressly confirming acceptance of both the Quotation and the version of these Terms supplied with it.
30.3 The email acceptance, accepted Quotation or Estimate and supplied Terms should be retained with the
job record so the scope, price and applicable version can be identified.
30.4 Unless a later document expressly states otherwise, the order of priority in the event of inconsistency
is: (a) an approved written variation; (b) the accepted Quotation and its job-specific scope, assumptions and
exclusions; (c) plans, drawings, schedules or specifications expressly referenced in the Quotation; (d) an
applicable schedule of charges supplied before the relevant instruction; (e) these Terms; and (f) other
written communications forming part of the agreement.
30.5 A document with higher priority prevails only to the extent of the particular inconsistency. The
remaining provisions continue to apply.
30.6 No verbal statement changes the contract unless it is subsequently confirmed by email in accordance
with these Terms.
30.7 Nothing in this Section excludes information or a term which applicable consumer law treats as
included in the contract.
30.8 If any individual term is found unlawful or unenforceable, it will not apply to that extent and the
remainder will continue so far as legally possible.
31. Diagnostics and Fault-Finding
31.1 Diagnostic work may be progressive because more than one fault, an intermittent condition or a
concealed defect may exist.
31.2 A diagnostic attendance is chargeable for the investigation undertaken and does not guarantee that
the cause can be identified within a single attendance or without further testing, dismantling, access or
replacement of components.
31.3 A recommended repair is based on the evidence reasonably available at that stage. Completion of that
repair does not guarantee resolution of every symptom where another independent or concealed fault
exists.
31.4 Further diagnostic or repair stages will require approval under Section 4 unless immediate safety
action is reasonably necessary.
32. Heating System Cleaning and Water Treatment
32.1 Chemical cleaning, MagnaCleanse, powerflushing, filter cleaning and water treatment are intended to
improve system cleanliness and performance but cannot guarantee removal of every deposit, blockage or
contaminant.
32.2 Cleaning or circulation may reveal or contribute to failure of components, seals, valves, radiators or
pipework already weakened by corrosion, age, debris or previous treatment. This does not automatically
establish defective workmanship where reasonable care and the relevant process were used.
32.3 Can Do Plumbing will report material defects identified during the process. Repairs, replacement
components, repeated cleaning and access beyond the quoted scope are excluded unless approved as a
variation.
32.4 Water-test results represent the sample and conditions at the time of testing. Ongoing system
condition may be affected by leaks, replenishment, alterations, untreated additions or pre-existing
contamination.
Can Do Plumbing - Terms of Business v4.2 | Page 20
Page 21 of 22
CAN DO PLUMBING
33. Drain Clearance and Leak Investigation
33.1 Drain clearance addresses the accessible obstruction encountered at the time and does not guarantee
against recurrence where the underlying cause includes damaged, displaced, poorly graded, restricted or
inaccessible drainage.
33.2 Camera inspection is limited by access, water, deposits, bends, pipe diameter, visibility and equipment
reach. It does not guarantee identification of every defect.
33.3 Leak investigation may require staged testing, monitoring and destructive access through flooring,
walls, ceilings, boxing, cabinetry or finishes. Such access is excluded unless expressly included or approved
as a variation.
33.4 Identifying or repairing one leak does not guarantee that no other leak or independent source of
water ingress exists.
33.5 Making good following investigative access is governed by Sections 11 and 12 and is included only
where expressly stated.
34. Application to Consumer Clients
34.1 These Terms are intended to operate consistently with mandatory consumer law. A term which would
remove or restrict a Consumer Client's mandatory right will not apply to that extent.
34.2 Can Do Plumbing will perform consumer services with reasonable care and skill. Nothing in these
Terms excludes liability for failing to do so.
34.3 Information which applicable consumer law treats as part of the contract, including qualifying
statements about the service relied upon by the Consumer Client, remains part of the contract
notwithstanding the document-priority provisions.
34.4 Where a consumer term is capable of more than one meaning, it will have the meaning required by
applicable law. The purpose of the detailed scope, assumptions and exclusions is to describe the service
transparently, not to remove mandatory remedies.
35. Application to Commercial Clients
35.1 A Commercial Client confirms that the person accepting the Quotation has authority to bind that Client
and that the Works are being obtained mainly for business purposes.
35.2 Subject to liability which cannot lawfully be excluded, Can Do Plumbing is not responsible to a
Commercial Client for indirect or consequential business loss, loss of profit, loss of revenue, loss of rent,
loss of opportunity or business interruption unless that category of loss is expressly accepted in the
Quotation.
35.3 A Commercial Client may not set off an alleged claim against an undisputed invoiced sum unless the
amount of the set-off has been agreed by Can Do Plumbing or finally determined by a court or agreed
dispute-resolution process, subject to any mandatory legal right.
35.4 The Commercial Client is responsible for maintaining property, contents, business-interruption and
other insurance appropriate to its own risks. This clause does not exclude liability arising from Can Do
Plumbing's breach.
36. Voluntary Alternative Dispute Resolution
36.1 After Can Do Plumbing issues its final complaint response, either party may propose voluntary
alternative dispute resolution.
36.2 Any consumer ADR referral will use a provider permitted to act under applicable law. No voluntary
referral will be made until the parties have agreed in writing upon the provider, scope, procedure,
whether the outcome will be binding and how the provider's fees will be allocated.
Can Do Plumbing - Terms of Business v4.2 | Page 21
Page 22 of 22
CAN DO PLUMBING
36.3 Participation in negotiation, mediation or other alternative dispute resolution does not constitute an
admission of fault or liability and does not prevent either party from obtaining legal advice.
37. Governing Law
37.1 These Terms are governed by the laws of Scotland.
37.2 Disputes shall be subject to the jurisdiction of the Scottish courts where applicable. Nothing in this
clause deprives a Consumer Client of a mandatory right to bring proceedings in another court which
applicable law permits.
